Executive Summary:

Since 1996, the Sonoma County Water Agency (Sonoma Water) has had an agreement to sell water to the Camp Meeker Recreation and Park District (Camp Meeker), which provides water to residents of Camp Meeker. The current agreement allows for Camp Meeker to divert up to 35 acre-feet per year of water from the Russian River through its diversion system and expires June 30, 2026. This item recommends authorization for the General Manager of Sonoma Water to execute a one-year extension of the First Amended Agreement for the Sale of Water between the Sonoma County Water Agency and Camp Meeker Recreation and Park District (First Amended Agreement).

 

Discussion:

HISTORY OF ITEM/BACKGROUND

Sonoma Water and Camp Meeker entered into an agreement for the sale of water, dated July 9, 1996 (Original Agreement). The Original Agreement authorized diversions of up to 90 acre-feet per year (ac-ft/yr) under Sonoma Water’s water rights when Camp Meeker's own water rights do not authorize diversions. These diversions are authorized through an existing point of diversion on the Russian River, not from Sonoma Water’s transmission system. The Original Agreement was amended on November 9, 1999 (Amendment No. 1), to temporarily allow water trucks filled in Camp Meeker to serve water to the Occidental Community Services District (Occidental), which was facing inadequate water supplies. The provisions added under Amendment No. 1 were temporary and expired on January 1, 2001, while the Original Agreement remained in full force and effect. Inadequate water supply issues recurred in Occidental in 2008, and, in response, Amendment No. 2 was signed on December 9, 2008. Amendment No. 2 authorized Camp Meeker to supply Occidental water when Occidental's water sources were inadequate to meet demands. The provisions added under Amendment No. 2 remained in effect during the term of the Original Agreement. Protracted negotiations for renewal of the Original Agreement resulted in one-year extensions in 2014 and 2015, and a six-month extension in June 2016. On October 18, 2016, the parties executed the First Amended Agreement, which contains similar terms as the Original Agreement but with several notable changes. The First Amended Agreement includes a reduction in the maximum annual amount of diversions from 90 ac-ft/yr to 35 ac-ft/yr, the addition of Occidental’s service area to the authorized place of use term, and the addition of annually assessed charges.

 

The First Amended Agreement is set to expire on June 30, 2026. Since January 2026, Sonoma Water has been in discussions with Camp Meeker to draft a renewal agreement; however, the parties have agreed to a one-year time extension to the First Amended Agreement to allow sufficient time for review and agreement on new terms and conditions. Upon the conclusion of negotiations, Sonoma Water staff will return to the Board for authorization of the new agreement.

 

California Environmental Quality Act

The General Manager has determined that the proposed one-year extension of the First Amended Agreement is exempt from the California Environmental Quality Act under Section 15301(c) because the future levels of diversions and use of water by Camp Meeker under the First Amended Agreement will not be significantly different from existing levels of diversion and use and involves no expansion of existing use.

The water supply agreement with Camp Meeker provides an additional supply to the water supply portfolio for the communities of Camp Meeker and Occidental that serves to improve system resilience under times of water shortage in the Russian River watershed.

Narrative Explanation of Fiscal Impacts:
