Executive Summary:

The Sheriff’s Office contracts with Sonoma Raceway to provide supplemental law enforcement security services to preserve the peace for various racing events held occasionally. The recommended action before the Board would delegate authority to the Sheriff to execute supplemental law enforcement security services agreements and any associated amendments at Sonoma Raceway events and receive full reimbursement for actual direct and indirect costs. Sonoma Raceway racing event reimbursement costs have averaged $379,978 annually in the past. Any reimbursed costs will correlate directly with the annual Board adopted fees for supplemental law enforcement security services and the terms of all agreements would be subject to County Counsel review.

 

Discussion:

Government Code Section 53069.8 allows the Board of Supervisors to contract on behalf of the Sheriff to provide supplemental law enforcement services to private entities to preserve the peace at special events on an occasional basis.  Contracts shall provide for full reimbursement of the actual costs.  Services shall be rendered by peace officers and shall not reduce the normal and regular ongoing services that would otherwise be provided. 

 

The Board of Supervisors delegated authority to the Sheriff-Coroner to execute contracts for supplement law enforcement security services up to $25,000 in 1993.  (Resolution 93-1720).  This delegated authority is insufficient to cover the actual costs of services provided at Sonoma Raceway events due to the size of multiple-day events at the Raceway, including national events such as NASCAR and NHRA.  For example, the costs for the 2024 NASCAR event are estimated to exceed $200,000.  Accordingly, the Sheriff’s Office has brought agreements for supplemental law enforcement services with Sonoma Raceway annually to the Board for approval, although the agreements and general scope of services have remained essentially the same over the years. 

 

To allow for a more efficient process and avoid multiple Board items annually for essentially the same contracts, the Sheriff’s Office is now asking the Board to delegate authority to the Sheriff or designee to execute supplemental law enforcement services with Sonoma Raceway for occasional special events in excess of the already existing delegated amount, in consultation with County Counsel. The Sheriff requests increased delegated authority to execute supplemental law enforcement  security services agreements and any associated amendments at Sonoma Raceway events only. For all other supplemental law enforcement security services agreements, the Sheriff’s Office intends to maintain Resolution 93-1720.

 

The Sonoma County Sheriff's Office has been providing special security services to Sonoma Raceway for thirty years with the exception of FY 19-20 when the event was cancelled due to the COVID-19 pandemic. The services provided under these agreements are above and beyond the normal level of law enforcement services provided to the community by the Sheriff's Office. The County is reimbursed by Sonoma Raceway for both the direct and indirect costs of providing these supplemental security services, as required under Government Code Section 53069.8.

 

The scope of services provided typically includes sergeant, deputy, dispatcher, and community services officer staff time, and patrol vehicle costs. Historical costs for these occasional special event services average $379,978 annually.  Annual agreements for supplemental services at the Raceway have historically been consistent in scope and staffing needs. The scope of services to be provided will in no way interfere with regular law enforcement services provided by the Sheriff’s Office.  The operational costs and corresponding revenue reimbursement are included in the Sheriff’s Office annual adopted budget. The recommended action before the Board would delegate authority to the Sheriff to execute supplemental law enforcement security services agreements to preserve the peace at special events on an occasional basis at Sonoma Raceway and receive reimbursement for actual direct and indirect costs.

 

The Sheriff is requesting authorization, in consultation with County Counsel, to execute supplemental law enforcement security services agreements at Sonoma Raceway racing events and receive reimbursement for direct and indirect costs. Samples of the type of agreements which the requested delegated authority would cover are attached.

Board approved annual Sheriff’s Office Fee Ordinance No. 6414, which sets the fee for supplemental security services provided by the Sheriff’s Office.

 

With the exception of FY 19-20 due to the COVID pandemic, the Board has approved annual Sonoma Raceway supplemental security services agreements since 1991.

Narrative Explanation of Fiscal Impacts:

The Agreement calls for the reimbursement of both direct and indirect costs associated with providing supplemental security services at Sonoma Raceway events.  The actual invoiced amount is determined at the conclusion of the event and is calculated using annual Board adopted fees for supplemental law enforcement security services.
