Executive Summary:
The Airport Boulevard freeway interchange with US Route 101 north of Santa Rosa was improved by the California Department of Transportation (CalTrans) in 2014. CalTrans has identified two right-of-way areas owned by the County and in need of transfer to Caltrans for the project. These areas are identified in the Right of Way Contract as parcel numbers 62309 (36,726 sf) and 62316 (20,005 sf). Section 83 permits the State to obtain road rights-of-way without compensation from counties when required for State highway. Upon invocation of the State’s power under Section 83, transfer of rights-of-way is compulsory.
Discussion:
The eastern section of Airport Boulevard right-of way (parcel 62309) lies adjacent to the freeway interchange with US Highway 101 prior to its intersection with Fulton Road. The western section of Airport Boulevard and Mark West Station Road right-of-way (parcel 62316) lies adjacent to the freeway interchange with US Highway 101 on the approach to the Sonoma County Airport. CalTrans has requested transfer of these portions of Airport Boulevard in accordance with Section 83, Streets and Highway Code.
The State has acknowledged that existing public utility facilities may lie within the Section 83 area. The facilities that will be allowed to remain separate utility agreements were executed at the time of project construction prior to 2014.
Government Code section 25365 allows for conveyances and transfers of real property no longer required by the County to the State of California upon agreed terms, upon a 4/5ths vote.
Government Code sections 25365 and 6061 require one-week advance public newspaper publishing of the Board’s notice of intent. Staff published the notice of intent in the Press Democrat on October 18, 2023 to provide public notice and comply with Government Code requirements.
