B)                     Award the contract to Summit Signal, Inc. (dba Danny Mihelcic Construction Services) for $529,676.63 for construction of Russian River County Sanitation District Main Lift Aboveground Diesel Fuel Tank and authorize the Chair to execute the contract.

C)                     Authorize Sonoma County Water Agency’s General Manager acting on behalf of Russian River County Sanitation District to sign Section 00 65 23 (Agreement and Release of Any and All Claims), with County Counsel review, if any unresolved claims are listed by the contractor.

Executive Summary:

This item requests approval of a contract with Summit Signal, Inc. (dba Danny Mihelcic Construction Services) for construction of Russian River County Sanitation District Main Lift Aboveground Diesel Fuel Tank. The project will include state-mandated removal of an existing single-wall underground storage tank (UST) and replacement with an aboveground storage tank (AST) at the Russian River County Sanitation District main lift station near Guerneville. Replacement will ensure the existing backup generator and lift station function during future power outages.

 

Discussion:

The Russian River County Sanitation District (District) main lift station pumps wastewater from the sewer collection system to the District’s treatment plant. A generator fueled by a diesel UST provides backup power for the lift station and ensures uninterrupted flow of wastewater. Without backup power, untreated wastewater will overflow the sewer collection system and may spill into the Russian River.

 

Effective September 25, 2014, Senate Bill (SB) 445 (Stats. 2014, Ch. 547) changed the design criteria for new and existing USTs. The single-wall UST at the Russian River County Sanitation District main lift station does not meet the revised design criteria and must be replaced on or before December 31, 2025.

 

Russian River Couty Sanitation District Main Lift Aboveground Diesel Fuel Tank consists of removal of Owner’s Main Lift diesel fuel tank and construction of a new compliant AST tank located at 17490 Highway 116, Guerneville, California including, but not limited to diesel piping improvements, monitoring system, electrical improvements, security fencing, and paving.

 

CALIFORNIA ENVIRONMENTAL QUALITY ACT

Sonoma Water’s General Manager has determined that the Project is exempt from the California Environmental Quality Act (CEQA) under CEQA Guidelines Sections 15301(b)(d) and 15304(f). The project will replace an existing UST and include grading and trenching to replace existing utilities. Replacement of the existing UST and minor alterations to land will not result in expansion of existing uses or removal of healthy, mature, scenic trees. Staff have prepared a Notice of Exemption in accordance with CEQA, the State CEQA Guidelines, and Sonoma Water’s Procedures for Implementation of CEQA.

 

The engineer’s estimate was $520,000. The Project was advertised for bids on December 19, 2024.

 

On January 28, 2025, 4 bids were received per the attached Bid Summary . The lowest responsive and responsible bid is from Summit Signal, Inc (dba Danny Mihelcic Construction Services) and is $9,676.63 above the Engineer’s Estimate.  Summit Signal, Inc. (dba Danny Mihelcic Construction Services) is experienced in this type of construction and met the experience requirements.

 

A contractor must execute a release of claims (Section 00 65 23) before final payment but may except any unresolved claims from the release. The requested action authorizes the General Manager to approve the release unless the contractor lists unresolved claims. In that case, County Counsel must review Section 00 65 23 prior to General Manager approval.

 

Section 00 67 00 (Escrow Bid Documents) of the Project Manual requires that the contractor submit bid preparation documents into an escrow account at a mutually agreeable institution.  The documents would be available later for review by Sonoma County Water Agency (Sonoma Water) and contractor in case of a dispute.  Sonoma Water staff has determined that this procedure is unnecessary for this Project and, after evaluation of the documents, Sonoma Water staff finds nothing out of the ordinary, and recommends that the Board authorize the General Manager of the Sonoma County Water Agency, acting on behalf of District to waive this requirement.

 

Construction on the Project is scheduled to begin approximately May 5, 2025, with an estimated completion date of January 9, 2026.
