B)                     Award the contract to Vellutini Corp dba Royal Electric Company for $2,666,666 for construction of the Ely Booster Station Hazard Mitigation and authorize the Chair to execute the contract.

C)                     Authorize the General Manager of Sonoma County Water Agency to sign Section 00 65 23 (Agreement and Release of Any and All Claims), with County Counsel review, if any unresolved claims are listed by the contractor.

D)                     Adopt a Resolution authorizing adjustments to the Board Adopted Budget for FY 2021/2022 for the Petaluma Aqueduct Capital Fund in the amount of $2,666,666.

Executive Summary:

This item requests approval of a contract with Vellutini Corp dba Royal Electric Company for $2,666,666 for construction of Ely Booster Station Hazard Mitigation Project that will demolish, relocate, and replace existing structures and appurtenances to elevate booster station equipment above the 500-year floodplain.

 

Discussion:

HISTORY OF ITEM/BACKGROUND

 

Ely Booster Station is part of the Sonoma County Water Agency’s (Sonoma Water’s) water transmission system. The station helps supply water to over 310,000 residents in Marin and Sonoma Counties by pumping potable water to the City of Petaluma, the North Marin Water District, and the Marin Municipal Water District. The booster station is within five miles of the Rodgers Creek Fault and sits within the 100-year floodplain.

 

The Ely Booster Station maintains adequate pressure in the aqueduct and pumps water to the City of Petaluma, the North Marin Water District, and the Marin Municipal Water District. Historically, the booster station has been inundated with floodwater during the rainy seasons. These floodwaters threaten the operability of the booster station.

 

The scope of work for the Ely Booster Station Hazard Mitigation Project includes sealing and elevating electrical appurtenances above the 500-year floodplain, replacing the pump motor housing structures and switchgear equipment, and anchoring equipment to meet seismic standards.  These actions would effectively provide protection against a 500-year flood event and potential seismic activity.

 

In 2019, FEMA approved the application and awarded a $2.3 million grant to fund the Ely Booster Station Hazard Mitigation Project.

The Engineer’s Estimate was $2,390,000.00.

 

The lowest responsive and responsible bid is from Royal Electric Company and is $276,666 over the Engineer’s Estimate. This additional construction contract cost can be attributed to the construction costs and challenges that stem from the global supply chain issues and worker shortages associated with the COVID-19 pandemic. Royal Electric Company is experienced in this type of construction and met the experience requirements.

 

A contractor must execute a release of claims (Section 00 65 23) before final payment but may except any unresolved claims from the release.  The requested action authorizes the General Manager of Sonoma Water to approve the release unless the contractor lists unresolved claims.  In that case, County Counsel must review Section 00 65 23 prior to General Manager approval.

 

Construction on the Project is scheduled to begin approximately April, 2022.

 

Sonoma Water recommends the Board take the following actions:

Narrative Explanation of Fiscal Impacts:

FY 2021/2022 additional appropriations in the amount of $2,666,666 are required to process this expense.  A budgetary resolution has been submitted with this item.  Offsetting revenue in the amount of $1,990,074 will come from a FEMA Hazard Mitigation Grant Program.  Non-grant funded contract work in the amount of $676,592 is funded under the Petaluma Aqueduct Capital Fund. Expenditures are reimbursed by FEMA grant funds quarterly.  The Petaluma Aqueduct Capital Fund has sufficient fund balance to cover any expenditures not reimbursed in FY21-22.
