Executive Summary:
Regional Parks proposes the County of Sonoma to enter into a Revocable License Agreement with Mark West Youth Club Little League, Inc. for the operation and maintenance of Maddux Ranch Park Little League fields, adjacent bleacher area, and parking lot for the period of December 6, 2022, through December 5, 2032, as necessary to meet the social needs of the community.
Discussion:
Mark West Youth Club Little League, Inc. (MWYCLL) has successfully operated and maintained two Little League ballfields and adjacent bleacher area and parking lot at Maddux Ranch Park since 1991 under revocable license agreements with the County. MWYCLL has been responsible for scheduling events for the playing fields, providing all infield care and area maintenance during the Little League season, removing garbage and litter resulting from games and practices, and repairing or replacing damaged or worn equipment or facilities such as backstops, signage, and fencing. The County is responsible for maintenance of the infields during the off-season in the months of August through February.
Pursuant to Government Code Section 26227, the Board of Supervisors may fund programs deemed by the Board to be necessary to meet the social needs of the population of the county, including but not limited to, the areas of health, law enforcement, public safety, rehabilitation, welfare, education, and legal services, and the needs of physically, mentally and financially handicapped persons and aged persons.
Section 26227 also allows the Board of Supervisors to make available to a public agency, nonprofit corporation, or nonprofit association any real property of the county which is not and, during the time of possession, will not be needed for county purposes, to be used to carry out such programs, upon terms and conditions determined by the Board of Supervisors to be in the best interests of the county and the general public.
Staff is recommending that the Board find that the proposed license with Mark West Youth Club Little League, Inc is necessary to meet the social needs of the community in the areas of health, public safety, welfare and education and that the property is not otherwise needed by the County for the term of the agreement.
The County and MWYCLL wish to create the agreement for ten years with an option to extend the agreement up to two, 5-year terms upon expiration of the initial term authorized by the Director of Regional Parks. The agreement can be canceled for any reason by either party with thirty days prior written notice.
