Executive Summary:
The intersection of State Routes 116 and 121 and the County’s Bonneau Road is under construction to install a Roundabout. Caltrans has identified a right-of-way area owned by the County and in need of transfer to the State for the project. The area is identified in the Right of Way Contract as parcel number 63861-1 (779 sf). Section 83 permits the State to obtain road right-of-way without compensation from counties when required for State Highway purposes. Upon invocation of the State’s power under Section 83, transfer of right-of-way is compulsory.
Discussion:
The portion of Bonneau Road right-of-way (parcel 63861) lies adjacent to State Route 116 at the intersection with State Route 121. Caltrans has requested transfer of this portion of Bonneau Road in accordance with Section 83 of the Streets and Highway Code.
The State has acknowledged existing public utility facilities may lie with the Section 83 area. The facilities will be allowed to remain under separate utility agreements executed prior to this conveyance.
Government Code section 25365 allows for conveyances and transfers of real property no longer required to the State of California upon agreed terms, upon a 4/5th vote. The Quitclaim Deed must be notarized at the time of signature.
Government Code sections 25365 and 6061 require one-week advance public newspaper publishing of the Board’s notice of intent. Staff plans to publish the notice of intent in the Press Democrat on or before January 2, 2024 to provide public notice and comply with Government Code regulations.
