Executive Summary:
The current Americans with Disabilities Act (ADA) Self-Evaluation Transition Plan has completed a majority of the barrier removal projects as identified in the 1992 and 2009 Plan. The plan approved in 2009 anticipated a phase 2, which included surveying unincorporated areas, identifying barriers in these areas, and developing a plan to remove these barriers. The requested action authorizes the development of a second phase of the Self-Evaluation Transition Plan to address barriers in unincorporated rural areas of Sonoma County.
Discussion:
The Board of Supervisors established the County’s original Americans with Disabilities Act Title II Program and Self-Evaluation and Transition Plan in 1992. The Transition Plan was updated in 2009 (with an informational update provided to the Board in 2017) and continues to be the current plan. The Self-Evaluation and Transition Plan (SETP) provides the analysis and roadmap for the improvements needed to ensure compliance with Americans with Disabilities Act Title II and articulates the County's commitment to improve access to County programs and services and provide accommodation to individuals with disabilities. The County of Sonoma has been and continues to be committed to providing equal access to buildings, programs, and services.

The County has completed 125 projects originally identified in the 2009 ADA Transition Plan, with several others nearing completion this fiscal year. The Board of Supervisors has authorized a total of $20,870,480 in funding to date for ADA projects in the Transition Plan. An additional $616,641 was contributed from the Fairgrounds and through Community Development Block Grants. Of the $19.2 million committed to projects, over $17.89 million has been spent to date, over $2.0 million are in active projects not yet completed, and over $1.2 million is planned for future projects in the near term.
As barrier removal at the County Administration Center is nearing completion of the scope originally identified in the SETP, barriers exist in the rural unincorporated areas that must be addressed. Such barriers include paths of travel to County owned buildings, parks, parking lots, Transit Bus stops, sidewalks, streets/public right of way features, and boating facilities. This request authorizes a second phase Self-Evaluation Transition Plan to survey County facilities/property in unincorporated areas and develop a plan to improve access beyond those barriers identified in the SETP of 2009. This new SETP for the unincorporated areas will provide a survey to determine how to best plan and budget for the completion of the barrier removal projects in facilities as defined by Title II of the ADA and to allow the County to track its progress. After the survey is conducted, staff will work with community stakeholders to develop a prioritized list of projects for subsequent implementation.
On January 28, 2021 the County released a Request for Qualifications and Proposals seeking professional services to develop the new SETP phase for unincorporated areas. Scope of work includes:
• Develop a new (Phase 2) ADA SETP for County facilities and locations that serve the public in the rural unincorporated areas of the county in accordance with the requirements as defined in Title II of the ADA as a database. Use of this data will provide for the long-term updates required when barriers are removed. The new ADA SETP will be created using the County’s existing ADA SETP format and existing barrier action codes.
• Utilize the County’s graphical information system mapping tools to identify ADA barriers and/or deficiencies, including but not limited to, County owned: buildings, parks, parking lots, County Transit Bus stops, sidewalks, streets/public right of way features, and boating facilities. Include any other County owned public access facilities that may be adjacent to other facilities and locations. Signalized Intersections, Park and Rides, County Road Yards and the Charles M. Schulz Sonoma County Airport in the unincorporated areas are excluded from this RFP as these facilities were recently surveyed or barrier removal is complete.
ADA barriers and/or deficiencies will be prioritized by facility and type of work based on building code requirements, community stakeholder input and include rough order of magnitude construction costs to assist the County in formulating the annual program of barrier removals. The new ADA SETP report will be ADA accessible for internet posting and without proprietary software/systems.
On March 4, 2021, three proposals were received in response to the Request for Proposals. Of the three proposals, Sally Swanson Architects Inc. was evaluated as most qualified firm. Swanson is a certified Local and Small Woman-Owned Business Enterprise (WBE, SBE, LBE, and U/DBE) located in San Francisco, CA. One their practice specialties is ADA Access compliance. Swanson has completed surveys and site audits on 13.3 million square feet; the project value of SSA’s plan reviews has been over a billion dollars ($1,194,000,000). And demonstrated comprehensive perspective on accessibility issues, focusing on balancing cost-effective solutions. Swanson has assisted numerous municipalities and governmental agencies in the formulation of their Self Evaluation Transition Programs and in design consultation to eliminate barriers. Cites include, for example, Santa Clara, San Rafael, Alameda, Richmond and Monterey.

Narrative Explanation of Fiscal Impacts:
The recommended action authorizes the Director of General Services to enter into a contract to perform the survey work. The $487,992 in funding described above was included in the Board of Supervisors FY 21-22 Capital Budget allocation for ADA program work. Additional appropriations are not needed at this time.
