Delegate authority to the Sheriff to execute the Fiscal Year 23-24 Organized Crime Drug Enforcement Task Forces Agreement between the Sonoma County Sheriff’s Office and the Department of Justice’s Organized Crime Drug Enforcement Task Force Program, and authorize the Sheriff to execute future Organized Crime Drug Enforcement Task Forces agreements and any modifications that do not substantially alter the scope of the agreement, to receive reimbursement for sworn staff overtime who assist various federal agencies in criminal drug investigations. The FY 23-24 estimated revenue is $25,925. Future agreements will be subject to County Counsel review and approval.

Executive Summary:
The Department of Justice, Organized Crime Drug Enforcement Task Force (OCDETF) Program has consistently worked in close partnership with State and Local Law Enforcement Organizations in the investigation and prosecution of Transnational Criminal Organizations (TCO’s). The Sheriff is requesting authorization to execute the FY 23-24 and future Agreements and modifications related to OCEDTF to receive reimbursements for participating in these various investigations.
Discussion:
The Sonoma County Sheriff’s Office often collaborates with other law enforcement agencies to investigate crimes. In partnership with other local law enforcement agencies, the Sheriff’s Office has been requested to assist OCDETF in the investigation and prosecution of TCOs. The Sheriff’s Office may perform a variety of functions including, but not limited to, interviewing witnesses, conducting surveillance, performing undercover assignments, handling informant transportation and/or prisoner transportation, preparing and executing search and arrest warrants, serving subpoenas, executing planned enforcement stops, and utilizing K9’s and their handlers. In return, the sponsoring Federal agency will provide reimbursement for related overtime costs, authorized travel, and per diem expenses resulting from participation in an OCDETF investigation.
There is a standard Policies and Procedures Manual that dictates the overall handling of OCDETF cases. Each individual OCDETF case requires a separate agreement be executed, however, the parameters for reimbursement remain universal between each agreement. An agreement must be completed whenever the Sheriff’s Office seeks reimbursement for participation in an OCDETF investigation. The agreement will be completed by Sheriff’s Administrative staff and will specifically list all deputies who may assist with the case. Only deputies listed are eligible for reimbursement. Occasionally a modification form may be necessary to add additional deputies not listed. Payments will be made directly to the Sonoma County Sheriff’s Office for salary and benefit expenses of the deputies designated in the agreement. The FY23-24 cap is $20,707.50 per officer. Payments will be made only on actual overtime hours worked on an OCDETF investigation. For this initial Agreement, the Sheriff is seeking authorization from OCDETF to exceed the $25,000 cap per Agreement, for a total Agreement amount of $25,925 for FY 23-24. The actual hours worked, and corresponding reimbursement will be based on the amount approved by OCDETF in the fully executed Agreement.
The Sheriff’s Office received the OCDETF agreement on October 6, 2023, with a deadline to return the signed document by November 9, 2023, leaving insufficient time to seek Board approval prior to the agreement deadline. The Sheriff is requesting retroactive approval of the execution of the October 6, 2023, Agreement, and additional authorization to sign future agreements and amendments.

Narrative Explanation of Fiscal Impacts:
OCEDTF will reimburse the Sheriff’s Office for eligible expenses. It is estimated 250 hours of overtime at an average rate of $103.70/hour will be applied to OCEDTF cases during the Federal fiscal year (October - September). Future year estimates are based on the standard cap of $25,000 per Agreement. For this initial Agreement, the Sheriff is seeking authorization from OCDETF to exceed the $25,000 cap, for a total Agreement amount of $25,925 for FY 23-24. The actual hours worked, and corresponding reimbursement will be based on the amount approved by OCDETF in the fully executed Agreement.
