Executive Summary:
At the February 6, 2024, Board meeting, the Board adopted Resolution 24-0035 placing the proposed Sonoma County Child Care and Children’s Health Initiative and Sales Tax Petition (“the proposed Initiative”) on the November 5, 2024, Presidential General Election.
This item asks the Board to adopt a Resolution making non-substantive clerical changes to the proposed designation of Sonoma County Code section numbers in the proposed Initiative. Staff proposes to change the currently proposed designation (Art. VIII, Chapter 12, Sec. 12-59 through 12-80) to Art. IX, Chapter 12, Sec. 12-70 through 12-91. This change has become necessary following the approval of the “Improved and Enhanced Local Fire Protection, Paramedic Services and Disaster Response Initiative” (Measure H) in the March 2024 election. Measure H uses the same Sonoma County Code section as the proposed Initiative, and those sections are now no longer available for the proposed Initiative.
Discussion:
On June 2, 2023, proponents of a quarter-cent transactions and use tax (a.k.a. sales tax) filed with the Sonoma County Registrar of Voters Office (ROV) a notice of intention to circulate the “Sonoma County Child Care and Children’s Health Initiative.” It proposes to ordain a new ordinance adding a new Article VIII, sections 12-59 through 12-80, to Chapter 12 (Finance and Taxation) of the Sonoma County Code.
On February 6, 2024, the Board adopted Resolution 24-0035 placing the proposed Initiative on the November 5, 2024, Presidential General Election. At that time, the designated code sections in the proposed Initiative were still available as next in sequence in Chapter 12 of the Sonoma County Code.
On March 5, 2024, Measure H was on the ballot for the Presidential Primary Election. It also proposed to ordain a new ordinance adding a new Article VIII to Chapter 12 of the Sonoma County Code, sections 12-60 through 12-69. Measure H was approved by the voters and Art. VIII, sections 12-60 through 12-69, have now been added to Chapter 12 of the Sonoma County Code to codify the “Improved and Enhanced Local Fire Protection, Paramedic Services and Disaster Response Transactions and Use Tax Ordinance.”
This means that the Sonoma County Code sections designated in the proposed Initiative are no longer available. Staff proposes to change the number designation in the proposed Initiative to the next available sections so that the Sonoma County Code can be arranged in an orderly and comprehensive manner in the event the proposed Initiative passes in the November 2024, Presidential General Election. Gov’t Code section 25126 allows the renumbering of code sections as part of the codification process for purposes of deduplication and clarity. The newly proposed sections would be: Art. IX, Chapter 12, Sec. 12-70 through 12-91. This is a non-substantive clerical change to the proposed Initiative. The changes are highlighted in the attached redline version of the proposed Initiative.
Staff is recommending that the Board adopt a Resolution making non-substantive clerical changes to the proposed Sonoma County Child Care and Children’s Health Initiative and Sales Tax Petition, to change the proposed section numbers from Art. VIII, Chapter 12, Sec. 12-59 through 12-80 (currently proposed sections) to Art. IX, Chapter 12, Sec. 12-70 through 12-91 (newly proposed sections).
