This item requests authority for the Sonoma County Water Agency's (Sonoma Water) General Manager to execute an agreement with the City of Cotati (City) for reimbursement to Sonoma Water for water use efficiency program assistance. Sonoma Water will conduct water use efficiency activities on behalf of City.
Discussion:
HISTORY OF ITEM/BACKGROUND
City and Sonoma Water share the goal of promoting increased water use efficiency in order to reduce operating costs, avoid or defer capital improvement costs associated with expansion of water supply and wastewater disposal systems, minimize associated environmental impacts, and meet the criteria and standards of state and federal regulatory agencies.
Through the 2006 Restructured Agreement for Water Supply, Sonoma Water is authorized to implement and fund water conservation measures that are cost-effective and will reduce water demands on Sonoma Water's water transmission system.
The Sonoma-Marin Saving Water Partnership (Partnership) was established on December 14, 2010, through a Memorandum of Understanding (MOU) between Sonoma Water and the following public agencies: City of Cotati, City of Rohnert Park, City of Santa Rosa, City of Sonoma, City of Petaluma, Town of Windsor, Valley of the Moon Water District, North Marin Water District, and Marin Municipal Water District. The MOU, which allows for members of the Partnership to participate in regional programs offered through Sonoma Water, was amended in 2018 (First Amended MOU) to determine the amounts to be budgeted and expended by the Partnership for an additional 10 years to 2028.
Sonoma Water and City will cooperate to develop, implement, and fund a water use efficiency program (Program) and City desires Sonoma Water's assistance in developing and implementing City's water use efficiency measures.
City is requesting water use efficiency services and materials from Sonoma Water for implementation and administration of City's Program and will reimburse Sonoma Water for its costs.
SERVICES TO BE PERFORMED
Under the proposed agreement, Sonoma Water will provide assistance with various water use efficiency measures administered by City, and provide staff to respond to incoming conservation calls from City customers, as needed. Sonoma Water will assist City with Program management including, but not limited to, verifying customer eligibility, processing rebates, tracking participation, developing marketing or outreach materials, purchasing efficiency devices and supplies, and scheduling Program-related appointments. City is requesting services and materials for implementation of City’s Program including various rebates and measures as follows:
1. Water Smart Home Survey
2. Large Landscape Water Use Survey
3. Commercial, Industrial, and Institutional Water Use Survey
4. High Efficiency Toilet Rebate
5. Cash-for-Grass Turf Replacement Rebate
6. Purchase of Water Efficiency Devices and Supplies
The agreement includes authorization for the General Manager to make changes to lengthen time schedules or make minor modifications to the scope of work, which do not increase the amount paid under the agreement, in a form approved by County Counsel.
The agreement includes two options for either party to extend the term for a period of one year each by providing written notice to the other party thirty days in advance of the expiration date of the agreement and of the first extension option. The extension will be formalized in an amended agreement or amendment signed by Sonoma Water and City.
Revenue received for the term of the Agreement will not exceed $37,000; the term end date is March 31, 2028.

Narrative Explanation of Fiscal Impacts:
Budgeted amount of $5,000 is available from FY 2022/2023 appropriations for the Water Transmission System Water Conservation Fund. City of Cotati will reimburse Sonoma Water in full for Program assistance on behalf of the City.
FY 2024/2025, 2025/2026, and 2026/2027, and 2027/2028 appropriations will be budgeted in those fiscal years.
