Executive Summary:

Since the 1990’s the Sonoma County Water Agency’s Airport-Larkfield-Wikiup Sanitation Zone has provided sewer service to a small area within the Town of Windsor’s sphere of influence. Service has been provided through an agreement between the Sonoma County Water Agency (Sonoma Water), Town of Windsor (Town) and the Windsor Water District (District). The Town, District, and Sonoma Water are updating the “Restated Agreement Between the Sonoma County Water Agency, the Town of Windsor and the Windsor Water District Regarding Provision of Sewer Service by the Airport-Larkfield-Wikiup Sanitation Zone of the Sonoma County Water Agency” to reflect current conditions and recent annexations of lands into the Town.

 

Discussion:

In February of 1993, the County of Sonoma and Town of Windsor entered into an “Agreement Between and Among County of Sonoma, Town of Windsor, and Windsor Water District Regarding Provision of Sewer Services to Airport-Larkfield-Wikiup Area” by which the County’s Airport-Larkfield-Wikiup wastewater facilities provided sewer service to a small area within the Town of Windsor. The original agreement was amended several times between 1993 and 2003.

 

This proposed amendment provides for the provision of sewer services to areas annexed into the Town.  The lands included in this amended agreement includes the following parcels (assessor parcel numbers, APN):  164-150-031; 164-150-032; 164-150-033; 164-150-034; 164-150-035; 164-150-036; 164-150-037; 164-150-038; 164-150-039; 164-150-040; 164-150-046; 164-150-047; 164-150-048; 164-150-050; 164-150-057; 164-150-059; 164-150-062; 164-150-063; 164-150-064; 164-240-001; 164-240-002; and 164-240-006.

 

In addition, the Airport-Larkfield-Wikiup Sanitation Zone will provide sewer services, including treatment, storage, and disposal of wastewater from the area identified, up to a maximum of Ninety Thousand (90,000) gallons per day, as measured by the average daily flow during the month of maximum flow.  Sonoma Water, on behalf of Town, will continue to be responsible for billing and collecting all fees and charges due from the parcels. With respect to any delinquent accounts, the Town agrees to cooperate with Sonoma Water's General Manager and, if the General Manager requests, to take all reasonable steps necessary to place any delinquent amounts on the tax roll as a lien against the property to which the delinquent account relates. All payments received from the parcels included in the Second Amended Restated Agreement shall belong to the Airport-Larkfield-Wikiup Sanitation Zone.

 

California Environmental Quality Act

The approval of the Second Amended Restated Agreement Between the Sonoma County Water Agency, the Town of Windsor and the Windsor Water District is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(b) (Existing Facilities) of the CEQA Guidelines, because the proposed project would not involve significantly different levels of wastewater treatment and involves no expansion of existing facilities.

 

Staff request the Board of Directors of Sonoma Water adopt the attached resolution approving the “Seconded Amended Restated Agreement Between the Sonoma County Water Agency, the Town of Windsor and the Windsor Water District Regarding Provision of Sewer Service by the Airport-Larkfield-Wikiup Sanitation Zone.”
