Adopt a Resolution pursuant to California Vehicle Code Section 22511 to designate certain stalls and spaces on County roadways and off-street parking facilities for electric vehicle (EV) charging purposes, and authorize enforcement thereof, including establishment of associated parking penalty fines.

Executive Summary:

Sonoma County continues to promote sustainability and reducing greenhouse gas emissions by supporting adoption of electric vehicle (EV) infrastructure and zero carbon transportation efforts. In order to continue incentivizing EV adoption among County employees, Sonoma County Public Infrastructure (SPI) is requesting local enactment of authority and prohibitions as allowed under California Vehicle Code Section 22511. If approved by the Board, SPI will be authorized I to designate EV charging spaces and enforce appropriate usage.

 

Discussion:

The County’s Clean Commute Program has proven to be a successful model for encouraging EV adoption and clean commuting among County employees.  As a result, the County has observed increased demand for EV charging infrastructure, particularly on the County campuses and adjacent public streets.

Without enforceable restrictions, EV charging stalls are at risk of being occupied by internal combustion engine vehicles or EVs not actively charging, which diminishes availability and discourages EV use. Enacting designations and enforcement options under California Vehicle Code Section 22511 will enable more effective oversight of EV designated parking stalls and will ensure charging infrastructure serves its intended users. Once EV charging spaces are designated under Vehicle Code Section 22511, Vehicle Code Section 22511.1 makes it unlawful to park in a designated space in violation of charging requirements. Violations are subject to statutory fines under state law (Vehicle Code Section 42001.6; $100 per violation, plus required fees and penalties) and vehicles could be subject to tow.

If approved by the Board, this Resolution will enable the Director of SPI to oversee the implementation of this program, including:

Site assessments and selection of designated EV charging stalls where appropriate, such as on public streets and at County facilities where charging infrastructure is installed and accessible;

Installation of signage and pavement markings in compliance with legal standards, and;

Coordination with Parking Enforcement to support consistent enforcement.
