B) Delegate authority to the Director of Transportation and Public Works to approve modifications to the agreement, including cost of service increases and changes to the list of traffic signals covered under the agreement.

Executive Summary:
When traffic signals are located on roads that fall into the jurisdiction of multiple public entities, it is customary for parties to enter into an agreement to share maintenance costs. The Department of Transportation and Public Works (TPW) is requesting authorization for the Director to execute an Agreement for Routine Maintenance and Energy Cost Sharing for Certain Traffic Signals located on the border of Sonoma County and the City of Rohnert Park. This is the first agreement between the City of Rohnert Park and TPW to share costs for traffic signals identified in Exhibit “A” of the proposed Agreement.
Discussion:
There are currently three traffic signals located on the boundary between Sonoma County and the City of Rohnert Park. Currently, TPW pays the full cost of maintenance and utilities for these signals. Under the proposed agreement, the City of Rohnert Park would begin paying a proportional share of the maintenance and utility expenses for the following traffic signals:
1. Petaluma Hill Road at Rohnert Park Expressway
2. Petaluma Hill Road at Valley House Drive
3. Stony Point at Wilfred Avenue.
In addition, traffic signals planned for Petaluma Hill Road at Keiser Road, and Petaluma Hill Road at Laurel Drive are included in the Agreement. The City of Rohnert Park will contribute to the cost of utilities and maintenance for these signals when placed in service.
Staff is recommending approval of the proposed agreement, which has a four-year term and includes allowances for cost of service increases over the term of the Agreement. In addition, TPW is also requesting authority be delegated to the Director to approve adjustments to the list of signals and associated cost adjustments over the term of the Agreement. The City of Rohnert Park formally approved this agreement at their April 13, 2021 City Council meeting.

Narrative Explanation of Fiscal Impacts:
Considering TPW has historically paid the full cost of utilities and maintenance for the traffic signals included in this agreement, the net fiscal impact will be an increase in revenue. Costs to maintain traffic signals are in the Road Maintenance budget, and approval of this agreement will partially offset those costs by generating approximately $3,768 in FY 2021-22. Revenue in future years will be determined by the timing of construction of additional traffic signals covered in this agreement and will be included in future budget submissions.
