Executive Summary:
The Department of Transportation and Public Works is requesting Board approval of the Third Amendment to the design contract with Quincy Engineering for replacement of Freestone Flat Bridge. The proposed amendment will increase the contract amount by $224,516 resulting in a new, not-to-exceed contract (including 10% contingency) amount of $833,116. In addition, if approved the amendment would extend the term of the contract from December 31, 2022 to December 31, 2025.
Discussion:
The Freestone Flat Bridge over Salmon Creek project (C11004) will replace the existing structurally deficient one-lane Freestone Flat Road Bridge (Bridge No. 20C-0440) with a new two-lane bridge designed to meet current design standards including improvements to roadway approaches and appurtenant facilities. The project will improve vehicular safety by providing two traffic lanes with shoulders. Due to the low traffic volume on Freestone Flat Road, pedestrians, bicycles and vehicles will share the travel lanes and shoulders.
A preliminary engineering/design contract was awarded to Quincy Engineering on September 24, 2013 by the Board of Supervisors. The original, not to exceed contract value was $429,980 with a term ending December 31, 2015. On November 10, 2015, the Board approved the First Amendment to the contract to extend the contract term to December 31, 2020. On July 23, 2019, a Second Amendment was approved increasing the total not-to-exceed amount of the agreement to $608,600 and further extending the term to December 31, 2022. The Second Amendment provided funding necessary to hire a sub-consultant (Panorama Environmental, Inc.) in order to initiate the California Environmental Quality Act (CEQA) and National Environmental Policy Act (NEPA) environmental approval process for this project.
The Third Amendment, requested in this Board Item proposes increasing the contract by $224,516 in order to finalize the California Environmental Quality Act (CEQA) and environmental documents, acquire permits from the environmental agencies and prepare a mitigation and monitoring plan for this project. Quincy Engineering has requested to continue using Panorama Environmental Inc., to complete this work. In addition, the proposed increase to the contract amount will fund updates to the bridge barriers for compliance; increased right-of-way, utility and environmental coordination, updates to plat and legal descriptions and record of survey, and updating the foundation report. Quincy Engineering’s geotechnical consultant, Crawford & Associates Inc., will update the foundation report.
Environmental consulting was included in the project’s original design request for qualifications in 2012. During contract negotiations, TPW determined that this work should be performed by in-house staff. Due to the dramatic increase in the volume of projects related to the 2017 floods, 2017 fire, 2019 flood and subsequent fires, TPW is reinstating this scope of work into the design contract to allow in-house staff greater flexibility to focus on disaster recovery efforts.
The project is 100% funded by the Federal Highway Bridge Program, and the proposed Amendment represents a redirection of the previously approved budget from in-house costs to consultant fees.

Narrative Explanation of Fiscal Impacts:
Appropriations for this project are included in the FY 2021-22 adopted Roads Capital budget (11051-34010103) and ongoing costs will be requested in future Roads Division annual budgets. The Federal Highway Administration has approved the project and is expected to reimburse 100% of costs associated with this amendment.
