C) Authorize the General Manager of the Sonoma County Water Agency to sign Section 00 65 23 (Agreement and Release of Any and All Claims), with County Counsel review, if any unresolved claims are listed by the contractor.

Executive Summary:
This item requests approval of a contract with Ranger Pipelines, Inc. for $3,495,596 for construction of Russian River Cotati Intertie Pipeline Seismic Hazard Mitigation at the Mark West Creek Crossing.
The Project is a natural hazard mitigation project identified in the Sonoma County Water Agency’s (Sonoma Water) Local Hazard Mitigation Plan (Plan) as a first-tier objective that will reduce the risk of damage or failure of the water transmission system as a result of a major seismic event. In January 2020, the Federal Emergency Management Agency (FEMA) obligated grant funding of $2,810,700 from their Pre-Disaster Mitigation Program to partially fund the design and implementation of Project.
Discussion:
HISTORY OF ITEM/BACKGROUND:
On January 8, 2008, Sonoma Water’s Board of Directors adopted its Local Hazard Mitigation Plan (Plan), which provides the basis for procuring grant funds from FEMA for natural hazard mitigation projects. The latest 2018 update to the Plan was adopted by Sonoma Water’s Board of Directors on October 9, 2018 and approved by FEMA on October 16, 2018. The Plan identifies the highest priority mitigation projects based on the findings of the Natural Hazard Reliability Assessment that Sonoma Water completed for its water transmission system. Sonoma Water has obtained and will continue to pursue funding to implement the projects identified in the Plan through FEMA’s Hazard Mitigation Assistance Programs, administered by the California Office of Emergency Services.
The Plan identifies the Project as one of several mitigation projects that could be implemented to reduce the risk of damage to or failure of the water transmission system as a result of potential vulnerabilities from a major seismic event. The Project will replace a portion of the Russian River-Cotati Intertie Pipeline where it crosses Mark West Creek near Forestville. The Project would largely eliminate the pipeline’s exposure to earthquake-triggered permanent ground displacement in the area by installing thicker walled and butt welded pipe designed to withstand the anticipated forces of the predicted permanent ground displacement.
In total, the Project will replace approximately 770 linear feet of 48-inch diameter pipeline. The pipeline design incorporates steel pipe with thicker walls, welded joints, flexible lining, valves, cathodic protection, and other appurtenant features designed to withstand the forces associated with the design seismic event.
Russian River-Cotati Intertie Pipeline Seismic Hazard Mitigation at Mark West Creek Crossing consists of seismic hazard mitigation of the Russian River Cotati Intertie Pipeline at the Mark West Creek Crossing located at 8150 River Road, Forestville, California, and 11,000 Wohler Road, Healdsburg, California, in an unincorporated area of Sonoma County. The Work includes, but is not limited to, the replacement of approximately 760 linear feet of 48-inch water transmission pipe with 0.5-inch-thick butt-welded steel AWWA C200 water transmission pipeline, and installation of a butterfly valve, air valves, and cathodic protection. Work shall be completed within 240 Days from the date when Contract Time commences to run.

The lowest responsive and responsible bid is from Ranger Pipelines, Inc. and is $760,820.00 below the Engineer’s Estimate. Ranger Pipelines, Inc. is experienced in this type of construction and met the experience requirements.
A contractor must execute a release of claims (Section 00 65 23) before final payment but may except any unresolved claims from the release. The requested action authorizes the General Manager to approve the release unless the contractor lists unresolved claims. In that case, County Counsel must review Section 00 65 23 prior to General Manager approval.
Construction on the Project is scheduled to begin approximately February 21, 2022, with an estimated completion date of August 20, 2022.
ALTERNATIVES
There are no viable alternatives to mitigate the seismic hazard to the Russian River Cotati Intertie Pipeline. Non-approval will also compromise Sonoma Water’s ability to comply with FEMA funding requirements. FEMA funding has been secured to cover a portion of the construction costs.

Narrative Explanation of Fiscal Impacts:
Budgeted amount of $3,495,596 is available from FY 2021/2022 appropriations for the Water Transmission Common Facilities Fund. Offsetting revenue in the amount of $1,957,534 will come from FEMA’s Pre-Disaster Mitigation Program. Sonoma Water’s cost share in the amount of $1,538,062 will come from the Water Transmission Common Facilities Fund.
