Executive Summary:
This is the final item required to purchase the real property located at 7011 Windsor Road, consisting of 0.42 acre of land with a 754 square foot single-family residence by the Charles M. Schulz - Sonoma County Airport. The first item was presented on April 20, 2021 and the Board of Supervisors declared Sonoma County’s intention to purchase 7011 Windsor Road, Windsor, CA.
Discussion:
The Department of Transportation and Public Works - Airport Division (“Airport”) is requesting final approval to purchase the property located at 7011 Windsor Road, Windsor, CA (APN 066-250-018) consisting of .042 acre of land with a single-family residence. This property is located within the Airport Master Plan, and is identified as a necessary acquisition to protect runway approaches, noise control, encroachments and setbacks at the Airport. This purchase of property is a voluntary acquisition by the Airport since the owner of the property contacted the Airport regarding the sale. Title to the property is currently held by Virginia Dow, as Trustee for the Dow Family Trust, dated January 10, 2005.
The resolution approving the intent to purchase of 7011 Windsor Road was granted by the Sonoma County Board of Supervisors on April 20, 2021. In addition, the Board of Supervisors also set the date of May 25, 2021 to finalize the purchase and authorized the Clerk to post and publish the statutory legal notices to purchase the property. The legal notices have been filed and no comments were received. It is anticipated that the majority of the property acquisition costs will be funded through the Airport’s Passenger Facility Charges. Passenger Facility Charges are federal fees collected from passengers utilizing commercial airline travel to and from the Airport. Any unfunded costs will be paid from operating revenues from the Airport Enterprise fund. The total acquisition cost is estimated to be $800,000: $665,000 for the purchase; $90,000 for relocation, moving and closing costs; and $45,000 for contract and administrative expenses.
Procedural Authority:
Pursuant to Government Code section 50470, a local agency may acquire property by purchase, condemnation, donation, lease, or otherwise for the purposes of this article and may use any real property which it owns or acquires within or without its limits as a site for an airport.
Government Code Section 25350 requires the Board to publish a notice of its intention to purchase property valued at more than $50,000, for three (3) successive weeks before consummation of the proposed purchase agreement. Pursuant to the Board’s prior action on April 20, 2021, all noticing and publication requirements have been met.

Narrative Explanation of Fiscal Impacts:
A Budgetary Resolution was requested and approved on April 20, 2021 transferring $800,000 into the Airport’s operating funds from its fund balance to cover the expenses for this purchase. The $800,000 anticipated cost of the property acquisition will be reimbursed by a specific $725,280 Federal Aviation Administration (FAA) grant designated for this purchase which is currently in the FAA approval process now. This is 90.66% of the purchase related expenses and the normal federal share of grant related purchases. The remaining $74,720, which would normally be the County’s share, will be reimbursed by CARES Act funds already approved.
