Executive Summary:
The Sonoma County Department of Health Services was notified by the California Department of Public Health, Food and Drug Branch, Tobacco Enforcement Section, that the County was selected to receive the Stop Tobacco Access to Kids Enforcement grant.
The grant agreement with the California Department of Public Health, Food and Drug Branch, Tobacco Enforcement Section, has been executed through the delegated authority of the Department of Health Services Director, in the amount of $395,076 through June 30, 2023. In order to implement activities related to the Stop Tobacco Access to Kids Enforcement grant program, the Department requires adoption of a resolution adjusting the fiscal year 2020-2021 budget to include the California Department of Public Health grant funding and associated expenditures.
Discussion:
The grant and the approved activities are proven to effectively support and ensure retailer compliance with existing tobacco laws. For jurisdictions that have a tobacco retailer licensing ordinance, as with the County of Sonoma, these activities are typically included in the fee paid by retailers. This grant funding will keep the County of Sonoma retailer license fees at $350 in fiscal year 2020-2021 instead of the Board approved fee of $525 implemented this fiscal year. This grant will provide a subsidy to the fee paid by the retailer for the next three years.
The grant allows the Department of Health Services, Impact Sonoma Tobacco-Nicotine Prevention team to expand its work significantly in the retail environment. The grant will provide for the team to provide annual visits to all 300-plus tobacco retailers in Sonoma County to check for compliance with laws, while also educating retailers on new policies and best practices to ensure adherence policies in order to decrease youth access to tobacco products.
Additionally, the grant will allow Department of Health Services staff to conduct compliance visits in all jurisdictions. Previously, the visits were in the incorporated areas only. Retail visits to all sites would help to provide data and encourage cities without a tobacco retailer licensing ordinance to pass an ordinance. The imposition of a fee on their retailers would be less should they agree to use the visit performance results from the Department of Health Services instead of performing their own compliance visits and youth purchase survey operations.
The grant activities are a way to assess and evaluate the effectiveness of tobacco retailer licensing policies as the County has four jurisdictions with tobacco retailer licensing policies of varying strength/component parts (Sonoma, Healdsburg, County of Sonoma, and Sebastopol), one jurisdiction (Cloverdale) with retail restrictions as municipal code, and four jurisdictions without any tobacco retail policy (Santa Rosa, Petaluma, Cotati, and Rohnert Park).

On August 11, 2020 the Board adopted a resolution delegating authority to the Director of Health Services, or designee, to accept funding allocations for the County of Sonoma and execute revenue agreements, amendments, and related documents received in fiscal year 2020-2021 as necessary to receive revenue from state and federal agencies.

Narrative Explanation of Fiscal Impacts:
Funding of $118,989 from the California Department of Public Health grant will be added to the fiscal year 2020-2021 budget via the attached budget resolution. Note: Funding of $140,234 for fiscal year 2021-2022 and $135,853 for fiscal year 2022-2023 will be included in the appropriate year budgets.
