Executive Summary:
Section 1.02, Rules and Regulations, of the Sonoma County Water Agency’s (Sonoma Water) Sanitation Code sets forth uniform requirements for wastewater users to the Sonoma Water's collection, treatment, and disposal systems, establishing terms and conditions for new and existing sewer services, and providing the policy and direction for the design, inspection, and construction of all sanitation works to be accepted, owned, and operated by the Agency. To facilitate any proposed transition of ownership of any Sanitation Zone or portion of a Sanitation Zone’s facilities to another entity (Receiving Entity) staff is proposing an amendment to the Sonoma Water’s Sanitation Code, to allow for such transition, such as the needs arise.
This Sanitation Code revision will allow for a Sanitation Zone wastewater contributor to comply with a Receiving Entity’s requirements for wastewater collection, treatment, disposal systems, policies and direction for the design, inspection, and construction of all sanitation works. The revision will also provide consistency for how regulations are implemented over two different entities.
Discussion:
Sonoma Water is a special district created pursuant to the Sonoma County Flood Control and Water Conservation District Act. Sonoma Water collects, treats, and recycles wastewater from various areas in Sonoma County, including the Airport-Larkfield-Wikiup Sanitation Zone, the Geyserville Sanitation Zone, Penngrove Sanitation Zone, and the Sea Ranch Sanitation Zone (Sanitation Zones).
Section 1.02, Rules and Regulations, of Sonoma Water’s Sanitation Code sets forth uniform requirements for wastewater users to Sanitation Zone's collection, treatment, and disposal systems, establishing terms and conditions for new and existing sewer services, and providing the policy and direction for the design, inspection, and construction of all sanitation works to be accepted, owned, and operated by Sonoma Water. To facilitate any proposed transition of ownership of any Sanitation Zone or portion of a Sanitation Zone’s facilities to another entity (Receiving Entity) staff is proposing an amendment to Sonoma Water’s Sanitation Code, Section 1.02 to allow for such transition, such as the needs arise.
To facilitate a transition of operations from Sonoma Water to a Receiving Entity, revising Sonoma Water’s Sanitation Code to allow the Board of Directors or the General Manager to accept compliance with a Receiving Entity’s requirements for wastewater contributors to the Sanitation Zone’s collection, treatment, and disposal systems and establishing terms and conditions for new and existing sewer services, and providing the policy and direction for the design, inspection, and construction of all sanitation works to be accepted will insure consistency for those users who fall under a Sanitation Zone’s program.
This revision will allow a Sanitation Zone user to have a clear path on what regulations they are to follow and will provide consistency for how regulations are implemented over two different agencies. In addition, this revision will assist with the transfer of other Sanitation Zones operations and maintenance, such as the needs arise.
California Environmental Quality Act
The General Manager has determined that adoption of the ordinance amendment is exempt from the California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines Section 15308 for Actions by Regulatory Agencies for Protection of the Environment because the amendment is regulatory in nature and would assure the protection of the environment.
