Executive Summary:

The Local Oil Spill Contingency Plan Grant Program is administered by the California Department of Fish and Wildlife's Office of Spill Prevention and Response. The grant program supports local governments adjacent to marine waters in updating their local oil spill contingency plans, attending Area Contingency Planning meetings, and participating in oil spill-related exercises. The grant program provides a maximum of $10,000 annually to Permit Sonoma Fire Prevention and Hazardous Materials Division for participation in the Area Contingency Plan meetings, training, and drills.

In 2008, the Board of Supervisors authorized participation in the Local Government Oil Spill Contingency Plan Coordination Grant program, granting the Director of the Department of Fire and Emergency Services the authority to submit applications and execute agreements for future years. Since that time, the County’s Fire Prevention and Hazardous Materials Division was moved from the Department of Fire and Emergency Services to Permit Sonoma, and the State agency’s name changed from California Department of Fish and Game to California Department of Fish and Wildlife. Today’s action adopts a resolution ratifying prior authorization to reflect these changes and to continue granting the Director of Permit Sonoma the authority to submit applications and execute agreements for future years.

 

Discussion:

The Lempert-Keene-Seastrand Oil Spill Prevention and Response Act (California Government Code Sections 8670.1-8670.95) designates the Office of Spill Prevention and Response (OSPR) within the California Department of Fish and Wildlife (CDFW) as the lead agency for oil spill prevention, emergency response, and statewide contingency planning. The Local Government Oil Spill Contingency Plan Grant Program provides funding to local governments adjacent to marine waters in updating their local oil spill contingency plans, attending Area Contingency Planning meetings, and participating in oil spill-related exercises.

 

The County has participated in the Grant Program since the early 2000s, initially under the former Fire and Emergency Services Department. In September 2008, the Board authorized the Director of the Fire and Emergency Services Department to submit applications and execute agreements for future years. However, since that time the Fire Prevention and Hazardous Materials Division moved under Permit Sonoma (2019) and the State Agency’s name changed from California Department of Fish and Game to California Department of Fish and Wildlife (2013). Permit Sonoma is requesting ratification of the prior authorization to reflect the official names of the California Department of Fish and Wildlife and the Permit Sonoma, Fire and Hazardous Materials Division, and to continue granting the Director of Permit Sonoma the authority to submit applications and execute agreements for future years, provided the agreement is in substantially the same form as that in Attachment 3.

 

The grant supports local area planning for oil spill response and provides a maximum of $10,000 annually to Sonoma County for reimbursement of costs incurred for Fire Prevention and Hazardous Materials staff’s participation in monthly area planning meetings for oil response hosted by the United States Coast Guard and the California Department of Fish and Wildlife, ensuring the County’s continued engagement and effectiveness in the Unified Command system during an actual offshore oil spill.

Narrative Explanation of Fiscal Impacts:

There are sufficient appropriations in the FY 2025-26 Permit Sonoma Hazardous Materials budget to cover costs associated with participation in monthly area planning for oil spill response meetings, funded by the Local Government Oil Spill Contingency Plan Coordination Grant program.
