Executive Summary:
The Carriage Lane Subdivision, Tract No. 1076 (MJS03-0005), was approved by Sonoma County Planning Commission on April 28, 2016 by Resolution 16-003. Misty Court and five new streetlights were constructed under grading and encroachment permits issued by Permit Sonoma to meet County of Sonoma Road Construction Standards, and consists of less than one quarter mile of new road. Misty Court was dedicated for public use and accepted by the County.
The Department of Transportation and Public Works recommends that the Board adopt a Resolution accepting Misty Court into the County Maintained Road System, accepting maintenance of five new streetlights, and designating the intersection at Misty Court and Carriage Lane as a stop-controlled intersection at Misty Court.
Discussion:
Construction of Misty Court, including five new streetlights, has been completed in the Carriage Lane Subdivision. These public improvements have been designed and constructed to meet local road construction standards.
California Streets and Highways Code Section 941 provides that roads may be accepted into the County Road Maintenance System by resolution of the Board of Supervisors. Misty Court was dedicated for public use and accepted by the County through the subdivision process, thereby creating a public road. The proposed resolution would accept Misty Court into the County Maintained Road System, which shifts road maintenance responsibility and liability for the public road to the County, thereby creating a “county highway”. The resolution would also accept five new streetlights into the County streetlighting system for maintenance purposes. Three of the streetlights are located on Misty Court and two are located on Carriage Lane.
Finally, Vehicle Code Section 21354 authorizes local authorities to designate intersections under their authority as stop-controlled intersections. In the interest of public safety and the orderly movement of traffic, the proposed resolution would designate the intersection at Misty Court and Carriage Lane as an all stop-controlled intersection and authorize the Director of Transportation and Public Works to erect appropriate markings and signage.

Narrative Explanation of Fiscal Impacts:
Expenditures for signage associated with this Board Item and maintenance of Misty Court are included in the FY 2022-23 Roads Maintenance budget (11051-34010102). Anticipated costs to maintain the road surface and signage will be included in future Road Maintenance budget requests. Roads Maintenance is primarily funded with allocations from State Highway Users Tax Account (HUTA) and Road Maintenance and Rehabilitation Act (SB1) as well as annual contributions from the General Fund. Expenditures for ongoing maintenance of the five street lights will be included in future CSA#41 - Countywide Lighting District (15101-34090100) requested budgets. The Lighting District is funded primarily through secured property tax collections.
