A) Approve the Plans and Specifications for the Mark West Creek Regional Park - Porter Creek Bridge Project (Project).
B) Authorize the use of $150,000 from Area 4 Park Mitigation Fees for project and adopt a Resolution authorizing a budget adjustment to the FY 2024-25 Mark West Creek Phase 1 Capital Project budget in the amount of $150,000 from Area 4 Park Mitigation Fees.
C) Award the construction contract to Gordon N. Ball, Inc. in the amount of $677,000.00 for a contract term of fifty (50) working days after the issuance of a Notice to Proceed and Authorize the Chair of the Board to execute the contract.
D) Authorize the Director of Regional Parks (or their designee) to make as needed minor changes to the project required by the final conditions, agency approvals, and other project conditions so long as the total does not exceed 10% of the total project cost.

Executive Summary:
The main access to Mark West Creek Regional Park and Open Space Preserve on Porter Creek Road is currently served by a gravel driveway and an old railcar bridge that spans Porter Creek. This bridge needs to be replaced to provide safe emergency vehicle access and comply with updated building codes. This new bridge is designed to handle up to 32 tons and is an integral component of the Mark West Creek Regional Park Phase 1 project. Ag + Open Space provided Initial Public Access Operations and Maintenance funding, including $640,000 towards the construction cost. Regional Parks recommends utilizing $150,000 from Area 4 Park Mitigation Fees for the remaining total construction and construction management costs of $790,000.
Discussion:
Mark West Creek Regional Park and Open Space Preserve is a 1,200-acre property located on Porter Creek Road that was acquired from Ag + Open Space in 2018. The property is currently open for public preview days on select Saturdays each year while a master plan is being prepared for the park. Staff anticipate the park will be open on a regular basis to the public, potentially as soon as the fall of 2025 after approval of the master plan and environmental document by the Board.
The new Porter Creek Bridge will be constructed adjacent to the existing bridge. The existing bridge will remain in place to serve current tenants and provide access to the property for staff and other service vehicles during the 3-month construction process.
The Porter Creek Bridge Project will provide the necessary emergency vehicle and large equipment access across Porter Creek to the main facilities at the park, including trailhead parking, equestrian facilities, and staff housing. This is critical infrastructure to protect the existing facilities from potential wildfire, support education programs, and to aid Regional Parks staff in managing the natural resources and public access within the park.
Staff recommends the Board approve the plans and specifications for the Mark West Creek Regional Park - Porter Creek Bridge Project, award the bid for the Project to Gordon N. Ball, Inc. In the amount of $677,000.00 for a contract term of fifty (50) working days and authorize the Chair of the Board to execute the contract.
Regulatory Permit & CEQA:
Regulatory Permits from the California Department of Fish and Wildlife, the North Coast Regional Water Quality Control Board, and Permit Sonoma have been issued and a Notice of Exemption was filed on September 1, 2022, for the Project. The Project was determined to be Categorically Exempt under Type-Class (1) California Code of Regulations, title 14, section (15301) maintenance of existing roads or structures.
Project Bidding:
The project was prepared for bidding and posted on the Purchasing portal on May 10, 2024. The engineers estimate for the project was $575,000 to $650,000. The Project was advertised for bidding in the Press Democrat on May 22, 2024. A non-mandatory pre-bid conference was held on site on May 30, 2024, to show the site to potential bidders. Three individuals attended the pre-bid meeting.
On June 11, 2024, at 2:00 PM electronic bids were opened for the Project. Two responsive bids were received for the Project as shown on the attached Bid Tabulation. The low responsive bidder was Gordon N. Ball, Inc. with a bid of $677,000.00.
Project Funding:
The Project is funded in part by Ag + Open Space under a Transfer Agreement with Regional Parks for Initial Public Access. This funding included $752,500 for construction of the new bridge as well as additional funding for park improvements necessary to provide year-round public access. Total bridge construction and construction management costs are estimated as $790,000. An additional $150,000 in funding is needed to construct the new bridge and for construction management of the Mark West Creek Regional Park Phase 1 capital project. Regional Parks recommends financing the remaining $150,000 with Area 4 Park Mitigation Fees.

Narrative Explanation of Fiscal Impacts:
Construction and construction management costs are estimated at $790,000. This will include required riparian mitigation planting and irrigation as well as first year monitoring and reporting. This year, $640,000 is available in the Mark West Creek Regional Park Phase 1 capital project budget. Area 4 Park Mitigation Fees has $336,494 available for budgeting this fiscal year. Regional Parks recommends allocating $150,000 of the available fund balance from Area 4 Park Mitigation Fees to cover remaining construction and construction management costs.
