Executive Summary:
North Bay Water District, a landowner district, called a general district election to take place on November 5, 2024, in order to fill five Director seats. For special district contests that have one or more nominees but insufficient nominees to trigger an election, EC § 10515(a) provides for the appointment of those nominees by the supervising authority (Board of Supervisors) to serve exactly as if elected as long as (1) no petition is presented from voters in the district requesting an election be held, and (2) a certificate of these facts is submitted by the district.
The enclosed resolution includes the names of the candidates who have qualified for appointment to the North Bay Water District Board of Directors pursuant to the above-stated provision of state law.
Discussion:
North Bay Water District is a landowner district located in southern Sonoma County. On May 14, 2024, the District’s Board of Directors passed a resolution calling for a general district election to be held on November 5, 2024, to fill three full-term (four-year) seats and two short-term (two-year) seats for the office of Director.
Candidate nominations ran from July 15, 2024, to August 9, 2024. In the end, five candidates filed - three for full-term seats and two for short-term seats. Since the number of candidates was equal to the available number of seats, California Elections Code §10515(a) provides for the appointment of the nominees by the “supervising authority” as long as no petition was presented from voters in the district requesting an election (no such petition was presented) and a certificate of these facts was submitted by the District (such a certificate was submitted and is enclosed).
For special districts, the “supervising authority” is the Board of Supervisors. The appointments must be made “at a regular or special meeting held prior to the Monday before the first Friday in December in which the election is held.” For the year 2024, that means no later than December 2, 2024. The last regularly scheduled Board meeting prior to that date is November 12, 2024.
Enclosed is a resolution that lists the names of the five candidates who have qualified for appointment to the North Bay Water District Board of Directors. Upon adoption of this resolution, the Registrar of Voters Office will issue certificates of election to the respective nominees.
