A)                     Approve the proposed Revocable License Agreement and fee structure with Ragle Beach Volleyball, Inc. for the operation and maintenance of the volleyball courts at Ragle Ranch Regional Park in Sebastopol for the period of July 18, 2023, through July 17, 2028, and authorize the Chair to execute the Revocable License Agreement.

B)                     Authorize the Director of Regional Parks to extend the agreement for the additional three (3) 5-year terms after the expiration of the current agreement.

Executive Summary:

Regional Parks proposes the County of Sonoma to enter into a Revocable License Agreement with Ragle Beach Volleyball, Inc. for the operation and maintenance of Ragle Ranch Regional Park volleyball courts for the period of July 18, 2023, through July 17, 2028, as necessary to meet the social needs of the community.

 

Discussion:

Ragle Beach Volleyball Club, Inc. is a 501(c)(3) non-profit organization.  They are a new non-profit; however, the members of the organization have played an active role in funding improvements and volunteering to help maintain the original 2 courts for the past 15-years.

 

With the passing of Parks for All Measure M, Regional Parks was able to fulfill this component of the Master Plan for the park by building an additional 2 volleyball courts at Ragle Ranch Park.  There are now a total of 4 courts at Ragle Ranch Park and an increased use pattern based on the quality of the courts.

 

Regional Parks has similar license agreements with other non-profit sports clubs to operate and maintain courts and fields throughout the parks system.  The members of these non-profit organizations are typically experts in their respective sports, possessing knowledge of the intricacies involved in the maintenance and operation of sports fields in the most cost-effective and community-oriented manner.

 

With the approval of this agreement, Ragle Beach Volleyball Club, Inc. will be responsible for the notification, scheduling, and designation of the volleyball courts for tournaments, league matches, clinics, and lessons and will provide low-income participants the opportunity to receive lessons and attend clinics for free or at reduced rate. 

 

Ragle Beach Volleyball Club, Inc. will be responsible, at its sole expense, to perform periodic tasks at the volleyball courts on the Premises, including but not limited to the following: periodic inspection of the volleyball courts; litter pick up; sand and beach maintenance; graffiti removal; net adjustments; repairs of minor damage to equipment; and removal or securing of hazards to the reasonable satisfaction of Regional Parks. 

 

Pursuant to Government Code Section 26227, the Board of Supervisors may fund programs deemed by the Board to be necessary to meet the social needs of the population of the county, including but not limited to, the areas of health, law enforcement, public safety, rehabilitation, welfare, education, and legal services, and the needs of physically, mentally, and financially handicapped persons and aged persons. 

 

Section 26227 also allows the Board of Supervisors to make available to a public agency, nonprofit corporation, or nonprofit association any real property of the County which is not and, during the time of possession, will not be needed for County purposes, to be used to carry out such programs, upon terms and conditions determined by the Board of Supervisors to be in the best interests of the county and the general public.

 

Staff is recommending the Board find the proposed license and fee structure for lessons and summer camps with Ragle Beach Volleyball Club, Inc, is necessary to meet the social needs of the community in the areas of health, public safety, welfare, and education and that the property is not otherwise needed by the County for the term of the agreement.

 

The County and the District wish to create the agreement for five years with an option to authorize the Director of Regional Parks to extend the agreement up to three (3) additional 5-year terms upon expiration of the initial term.  The agreement can be canceled for any reason by either party with thirty days prior written notice.
