Executive Summary:

Pursuant to California Elections Code (EC) §§ 1303 and 14052, a general district election is scheduled to take place on November 5, 2024, to elect district directors to numerous special district boards. For special district contests that had one or more nominees but insufficient total nominees to trigger an election, EC § 10515(a) provides for the appointment of those nominees by the supervising authority (Sonoma County Board of Supervisors) as long as no petition was presented from voters in the district requesting a general election be held.

 

The attached resolution includes the names of the candidates who have qualified for appointment to their respective special district boards pursuant to the above-stated provision of state law.

 

Discussion:

Candidate nominations for the November 5, 2024, General Election, ran from July 15, 2024, to August 9, 2024. Extended candidate nomination period for offices for which an incumbent officeholder did not file ran from August 12, 2024, to August 14, 2024. In total, 69 candidates residing in Sonoma County qualified for 74 open seats in 27 special districts. 16 candidates residing in Sonoma County are going to election in 5 contests (first table), leaving 53 candidates for the Board to appoint.

EC § 10515 requires that appointments to the office of district director be made by the “supervising authority,” which for special district offices is the Board of Supervisors. The appointments shall be made prior to “the Monday before the first Friday in December in which the election is held.” For the November 5, 2024, General Election, that date is December 2, 2024. Each person so appointed shall qualify, take office, and serve exactly as if elected at a general district election for such office.

 

For those offices for which no candidates filed or fewer candidates filed than the number of seats to be filled, state law provides that the supervising authority appoint any person who is qualified to hold each office as of November 5, 2024. Separate memos to the Clerk of the Board and to the supervisors will list the vacant positions in their district and the necessary qualifications for appointment. It will be incumbent upon the Board to identify qualified candidates and make the necessary appointments to fill the vacant seats.

 

Upon adoption of this resolution, the Registrar of Voters Office will issue certificates of election to the respective nominees.

Prior Board Actions:

On September 26, 2023, the Board of Supervisors authorized appointment of district directors in special districts with insufficient nominees to be on the ballot in the November 7, 2023, General Election (Resolution Number 23-0475). Note: No election ended up taking place on November 7, 2023, because none of the districts had sufficient nominees to trigger one.
