Executive Summary:
On January 24, 2024, the Department received a funding agreement from the State of California, California Department of Education (the State) allocating $15,768 to the Sonoma County Department of Health Services (hereinafter, “DHS” or “the Department”) to provide on-site health and sanitation inspections of the food service operations for the Summer Food Service Program.
On March 7, 2024, the Department received a funding agreement from the State of California, Department of Resources Recycling and Recovery allocating $106,369 to DHS to provide waste tire management through permitting, inspections, education and enforcement activities for the Local Government Waste Tire Enforcement Grants Program.
This item requests approval from the Board of Supervisors to enter into the funding agreements.
Discussion:
The State, Nutrition Services Division administers the U.S. Department of Agriculture (USDA) Summer Food Service Program (SFSP), which ensures children continue to receive nutritious meals when school is not in session. SFSP sponsors include public and private nonprofit organizations that prepare meals or purchase them from a school district or commercial vending company. Federal regulations require health inspections of the SFSP sponsors. Sponsoring organizations are required to notify their local health agency (Contractor) of their intent to operate an SFSP and they must operate within the standards prescribed by their local health agency. The USDA provides funding to reimburse the local health agencies for providing health and sanitation inspections for the agencies participating in the SFSP. If the Contractor does not perform these inspections, unsafe food in unsanitary conditions will potentially be served by agencies funded by the SFSP.
The California Department of Resources, Recycling and Recovery (CalRecycle or the State) administers various grant programs that support state efforts to reduce, recycle, and reuse solid waste generated in the state. These efforts work to preserve landfill capacity and protect public health and safety and the environment. The Department receives funding from CalRecycle to provide regulatory services for waste tires, solid waste handling, construction and demolition debris, and regulation of active and closed landfills.
On July 11, 2023, the Board adopted a resolution delegating authority to the Director of Health Services, or designee, to accept funding allocations for the County of Sonoma and execute revenue agreements, amendments, and related documents received in fiscal year 2023-2024 as necessary to receive revenue from state and federal agencies for various terms, with some being for multiple years.

The resolution delegating authority to enter revenue agreements does not grant staff authority in this case because the State seeks indemnification from the County. See Attachments 1 and 2.

Narrative Explanation of Fiscal Impacts:
DHS will add appropriations in the amount of $122,137 for revenues and expenses to FY 2023-2024 to reflect program activities for the Summer Food Service and Waste Tire Enforcement. Any funds not expended in FY 2023-2024 will be accrued to deferred revenue and recognized in the subsequent fiscal year with the concomitant expenses.
